The government, cantons and most political parties are backing a tightening of regulations governing casinos and lotteries, as well as efforts to prevent gambling.

The constitutional amendment will come to a nationwide vote on March 11 amid increasing competition from game operators abroad following the partial liberalisation of the gambling and betting regulations in Switzerland more than ten years ago.

The vote on money games – one of five issues to be decided on – may seem a simple formality, but the figures at stake are not to be scoffed at.
 
In 2010 about SFr1 billion ($1,06 billion) in revenue from casinos, lotteries and commercial bets went towards social projects and the old age pension scheme, according to official statistics.
 
But the various forms of gambling also incur considerable social costs, notably gaming addiction, fraud and even money laundering.
 
“This is reason enough for the government to intervene and set clear rules,” said Justice Minister Simonetta Sommaruga.

Addiction

A key provision in the proposed constitutional article foresees preventive measures to fight addiction, the protection of minors as well as fraudulent criminal activities, she added. “The federal and cantonal authorities have to take fully into account the risks of gambling.”
 
The proposal also clarifies the role of the federal authorities and the 26 cantons.
 
Setting clear rules and defining areas of competence helps to create legal certainty and ensure continued financial support for about 16,000 non-profit projects of public interest, according to Hans-Jürg Käser, president of an intercantonal body in charge of lotteries.
 
“Cantons and the federal government would suffer considerably if consumers in Switzerland were to use the services of foreign, illegal and criminal providers over the internet or in backrooms of bars and restaurants,” Käser said.

Competence and proceeds

Under current regulation, casinos need a licence from the federal authorities, while the cantons are responsible for regulating lotteries, bets and skill-based games.
 
The constitutional amendment leaves this competence largely unchanged but grants casinos the exclusive right to operate slot machines.
 
No major change is planned for the use of revenue generated. The federal contribution goes towards the state old age and disability insurance while the net yield from lotteries and sport bets is destined for non-profit projects.
 
But enshrining the agreements in the constitution will boost their legal importance according to Sommaruga.

Opposition

Most political parties voted in favour of the amendment when it was discussed in parliament last year.
 
A notable exception were the representatives of the small Protestant Party which have criticised what they consider an inherent contradiction as gambling is directly linked to revenue for non-profit projects.
 
“Thus there is a risk of encouraging money games. The amendment will increase the number of gamblers and also of addicts,” warned Maja Ingold, a parliamentarian for the centre-right group.
 
She points out that gambling addiction is a serious social problem. More than 28,000 incidents were recorded in 2010, according to Ingold.
 
The group is calling for further restrictions on the use of skill-based games such as Tactilo.
 
The proposal to be voted on is a counter-proposal to an initiative by a broad coalition of political parties, social and culture groups and sport organisations.
 
They handed in enough signatures in 2009 to force a nationwide vote, but withdrew their initiative after parliament thrashed out a compromise.

An employee of a Costa Rica-based website has been in South Florida for two months to try to talk Beasley Broadcasting’s Sports Talk WQAM-560 AM afternoon host Sid Rosenberg into making good on an alleged $44,500 in gambling debts. Frank Soviero, who says he works for www.1betvegas.com, tells the Miami Herald that Rosenberg lost on dozens of NFL, MLB, WNBA, NHL and college football games in just two weeks.

Soviero said he called WQAM GM Joe Bell to complain, Both Rosenberg, his producer and Bell declined comment.

“We can’t sue Sid since what we do is illegal in the United States,” Soviero said recently at Gulfstream Park. “I’ve tried everything. He comes up with 100 bucks here and there, and he gives me a big hug. It ticks me off because I talked my boss into giving Sid a few chances. And I’ve seen [my boss] do things when he gets mad.”

Soviero’s story comes as Rosenberg is back behind his microphone after a six-week suspension connected to his alleged gambling with another website. Soviero said he first met Rosenberg one Sunday in October. Because he was recommended by another 1betvegas.com user, Soviero said the website extended Rosenberg a $25,000 credit.

“He put $6,000 on the 4 p.m. NFL games that day. … He was betting on 10 to 15 games a day. He put $1,000 on the first-half score of a Tampa Bay game. Nobody does that.”

Soviero said he put Rosenberg on a payment plan. Rosenberg gave him $900 last month but he said Rosenberg, with tears in his eyes, told him it was money he had saved to take his children to Disney World: “I mean Sid no harm, but if he had won $20,000, he’d have expected, and received, the money on the spot.”

RBR-TVBR observation: We wonder why the FBI or local police in Florida aren’t arresting Soviero for trying to collect a bet that is illegal in the US.

Gov. Dannel P. Malloy maintains it’s only a matter of time before online gambling comes to Connecticut but a top legislative Republican says not so fast.

Senate Majority Leader John McKinney, a Republican from Fairfield, says online gambling is currently illegal in Connecticut and he believes it should stay that way. He says online gambling is “bad public policy” and poses “regulatory, social and public health challenges.”

McKinney’s comments came at a press conference this afternoon, one day before the legislature’s public safety committee is slated to hold an informational hearing on the topic.

Roy Occhiogrosso, a senior adviser to Malloy, dismissed McKinney’s comments. “Another day, another press conference by Sen. McKinney to criticize the Governor,” Occhiogrosso said via email.

“It’s pretty much all he does. The Justice Department decision makes clear that online gaming will eventually reach Connecticut.   Gov. Malloy is concerned about protecting jobs and revenue that are tied to the gaming industry, and looks forward to having a public dialogue on the issue in the coming weeks and months,” Occhiogrosso said.

The looming showdown on online gambling at the Capitol is the result of a recentU.S. Department of Justicedecision that Malloy says opens the door to online gaming. In fact, several states, notably New Jersey, are already laying the groundwork for online gaming.

Malloy contends that once the Internet gambling genie is out of the bottle in one state, it is legal everywhere, due to the free and open nature of the Internet.

But McKinney disputes that assertion. “Unfortunately, since [the DOJ] decision was issued, there has been widespread misinformation and misrepresentation on the issue of Internet and online gambling and sadly, much of that misinformation has come from the governor’s office and governor Malloy himself,” he said.

McKinney, a lawyer, says the DOJ ruling is far more limited in scope than Malloy indicated. Also, he notes that states routinely police the Internet for illegal activity, such as child pornography.

Instead of legalizing online gambling, McKinney is proposing legislation that would allow for stepped up enforcement of the state’s existing ban on online gambling.

The D.C. Council took a major step Tuesday toward reconfiguring the city’s $38 million lottery contract when it voted to repeal an online gambling law once urged by its supporters as a pivotal revenue source for the city.

Shortly before a 10-2 vote to kill the gambling initiative, known as iGaming, Mayor Vincent C. Gray said in a letter to the council that he would conditionally support a rebid of the entire contract if the council eventually revives iGaming.

Jack Evans, Ward 2 Democrat, who oversees the lottery as chairman of the council’s Committee on Finance and Revenue, said last week that more scrutiny of the lottery contract would be forthcoming after his committee advanced the iGaming repeal. His comments on the prospect of rebidding the lottery contract were tepid after Tuesday’s vote.

“I’m not doing anything right now, but I’d always be open to it, yes,” he said.

In his letter to the council, in which he reiterated his support for a repeal of iGaming, Mr. Gray said his position on the lottery contract itself was predicated on the passage of an iGaming law “in a much more publicly transparent manner” than the way it became law as part of a budget bill in December 2010.

“I also would support rebid of the existing lottery contract, with more transparent provisions that are subject to stricter adherence to both procurement law and best practices, and a fairer revenue-sharing arrangement with the District for any iGaming component,” he said.

Council member Tommy Wells, Ward 6 Democrat, who co-sponsored the repeal bill, said after Tuesday’s legislative session, “I certainly have a lot of questions about the process of selecting the [local] partner in the lottery contract, and that’s a conversation I will be having with Mr. Evans.”

Recent concerns about iGaming stem from a report by D.C. Inspector General Charles J. Willoughby, who determined that the city’s lottery contract with the Greek company Intralot “materially changed” to include the online games shortly after its approval in December 2009. Council members in favor of the repeal said they had no way of knowing that “nontraditional” games in the contract could amount to online gambling.

The inspector general issued his report in response to a written request for investigation by two officials at the time, D.C. Attorney General Peter J. Nickles and Chief Procurement Officer David P. Gragan, but not until after Mr. Evans asked Mr. Willoughby to act on the request.

The request for investigation was prompted by reports in The Washington Times that found irregularities in the lottery approval process and a lack of vetting of Intralot’s local partner, Maryland businessman Emmanuel S. Bailey. Mr. Bailey was found by the inspector general to have misrepresented his firm’s business activities during its bid for a stake in the lottery contract.

A spokeswoman for Mr. Gray said Tuesday that his perspective was shaped by the inspector general’s report and public opinion on the online gambling program.

“It’s a combination,” she said.

The council in December 2009 approved the lottery contract between Intralot, the sole awardee in a competitive bid process, and Veteran Services Corp. (VSC), a firm controlled by Mr. Bailey that was appended to the deal after the award. Intralot and VSC later executed a separate agreement that gave Mr. Bailey a 51 percent interest in a subcontracting entity consisting of VSC and Intralot.

Intralot said its company and VSC — which is on the hook for half the startup expenditures — spent $22 million launching the overall lottery system. Among those funds, it spent between $5 million and $7 million on the iGaming portion that will not happen — at least not for now.

VSC borrowed its share of startup expenses from Intralot.
